Bank charges finally ruled unfair?

Bank charges are once again making the headlines with the news of a verdict on the test case launched by the Office of Fair Trading (OFT) against seven major banks in July 2007.

The test case verdict went in favour of the OFT and could result in bank customers reclaiming bank charges worth millions of pounds. Before July 2007, some bank customers had successfully claimed back bank charges, whilst others were unsuccessful.

This inconsistent approach led to the OFT postponing all claims made over bank charges until the test case was completed. The verdict could have a detrimental effect on the seven banks involved (which were Barclays, Abbey, Clydesdale, HBOS, HSBC, Lloyds TSB, RBS and Nationwide Building Society) because they had previously raked in as much as £3.5 billion in charges each year.

The current economic climate is gloomy and recent weeks have seen banks forced to launch rights issue's due to low balance sheets and increased sub-prime debts. As it stands, if banks are forced to pay back the millions that customers are putting in claims for over charges, the credit crisis could be affected for the worse.

Until the case was settled, banks continued to charge over the odds for crimes as petty as going over an agreed overdraft by as little as £1 and charges can be more than £30 each time. As a result, there is a backlog of customers with claims pending who are expecting thousands back as a result of the test case verdict.

However, the Office of Fair Trading lead test case is not the end, other hearings are expected to follow to decide how much banks can charge and the banks involved could still appeal. As a result of the remaining uncertainty, pending bank charge claims remain on hold until more is certain.

The OFT filed the case because it was concerned that a charge of more than £30 for going over an agreed overdraft limit was unrealistic and unfair when administration costs can be as little as £2. Banks generally charge each time you exceed your limit, meaning if you pay for two separate items without realising it has taken you over the limit you could end up owing more than £60.

The case argued by many customers who are intent on reclaiming bank charges is that the speed at which bank charges added up was unfeasible. Some claimants have exceeded their limit by just £25 but the charges have added up to over £200. The OFT test case has ruled that bank charges come under Unfair Consumer Contracts rules, but whether or no claimants will be refunded and how much remains to be decided.

Smack, right up alongside the head. Your 401(k) investment program deteriorated rapidly as the stock market and the economy weakened. Who would have thought that there was so much risk of loss in those mutual funds, and ETFs? Fortunately, the pain is most often temporary, but the timing of the recovery could alter some participant retirement schedules and benefits--- not to mention the hefty confiscation level retirees can count on from Uncle Sam.

The popularity of self-directed 401(k) benefit plans is understandable. Employees typically get an instant profit from generous employer matching contributions, a variety of investment products to choose from, and portability between jobs. But the benefit to employers is far greater--- an easy, low-cost, employee benefit plan with virtually no responsibility for the safety of the investments, and no lifetime commitment to benefit payments. In some instances though, employees are required to invest too large a portion of their account in company stock--- a situation that has caused major problems in the past (Enron, for example).

401(k) plans have virtually replaced the private pension system, and in the process, have transferred total investment responsibility from trustee caliber professionals to hundreds of millions of investment amateurs. Employees get little professional guidance with regard to selecting an appropriate mix of investment vehicles from the glossies provided by 401(k) fund providers. Few Employee Benefit Department counselors have degrees (or hands-on experience) in economics, investing, or financial planning, and wind up using the "unbiased" counseling services of the funds' salespersons. How convenient for them. Interestingly, most salespersons also have no hands-on investment experience either--- go figure.

Similarly, the financial planning and accounting communities seem to have little concern about such basic investment tenets as QDI (quality, diversification, and income). If they did, there would never be instances where individual investors lose everything in their one fund, one stock, or one-property investment programs. QDI is the fire insurance policy of the investment plan, but few 401(k) participants hear about anything beyond: past market value performance numbers, future performance projections, and the like. They are not generally aware of the risks inherent in their investment programs.

This is where an understanding of investment grade value stock (IGVS) investing, the IGVSI and related market statistics becomes important to 401(k) participants, company benefit departments, accountants and other financial professionals. IGVS investing is just perfect for long-term, regular-deposit-commitment investment programs.

Somehow, we've got to get 401(k) investors to understand the framework of an investment/retirement program and, then, we have to get participants and/or their professional advisors to look inside the products being offered. As much as I hate the idea of one-size-fits-all investment products, they are generally accepted as the best way to deal with larger employer 401(k) programs--- most employers don't even know that more personalized approaches exist.

Only when some form of company, sector, or economy melt down occurs, does the head scratching (and the investigating) begin. 401(k) participants need to understand that they are not immune to the vagaries of market, economic, and interest rate cycles. Along with their employee benefit plan comes total responsibility for the long-term performance of the investment/retirement program. Are you in good hands?

Historically, IGV stocks fluctuate enough (both in general and by sector) to allow for mutual fund and ETF investors to select the less risky offerings from among the 401(k) product menu at the most advantageous times--- but all individual investors need to learn how to identify the risks and to learn how to deal with them. Typically, 401(k) participants buy the higher priced, last-year-best-performing, and hot sector offerings while they sell or avoid the various products they feel have "under performed" the market.

Nowhere else in their lives do they adopt such a perverse strategy. And nowhere else in their thinking would they blindly accept the premise that any one number represents what is, or should be, going on in their personal investment portfolios. Risk minimization begins with quality, is enhanced through diversification, and is compounded with realized income.

The first two steps require research, greed control, and discipline. The income part just requires discipline, so it should be much easier to manage. If you cannot identify and understand the individual securities within an investment product, and assess the overall quality (economic viability and risk protection), don't invest in it. If you have more than 5% of your portfolio in any one individual security, or 15% in any one sector (industrial, geographical, social, political, etc.), make some changes.

Since 401(k) plans are almost exclusively mutual fund shopping malls, it is difficult to assess the income or cash flow component of the risk minimization function. Product descriptions, or your benefits representative, should provide the answers. You can stay away from products that refuse to share the income with you, but the best way to benefit from a fund based benefit plan is to establish selling targets for the products you select. If your Blind Faith Fund Unit Value rises 10%, sell all or part of it and move the proceeds to another opportunity that is down 20%. Profit taking is the ultimate risk minimizer.

So long as we are in an environment where retirement plan income (and principal in the case of all private plans) is subject to income taxation, 401(k) participants would be wise to establish an after tax income portfolio invested in tax exempt securities--- or to vote more selfishly.

Today, it seems all too common that young people have very little appreciation for the concept of “work ethic”. The implications of this as it relates to the near crisis financial statistics in North America are huge.

Jobs are prolific and as a result, many young people don't seem to understand commitment or work ethic. They expect to have everything they want, when they want it; and when they don't they just move on, leaving a wake of hard-working, committed business owners and managers behind. They will often not move on quietly either. If they expect something they don't receive, they can be verbally abusive to the innocent shopkeeper behind the counter.

Their expectations are so high they become impatient or don't even see the value in what they're doing or learning at the time. Their respect for work and for training is negligible.

What I've discovered from sharing my story with my peers about a young employee I had is that everyone has at least one version and often multiple versions of the same story.

In North America, our youth are still looking for job security and high pay, with complete flexibility and lots of time off. They are still telling themselves they will save a lot of money so they can buy a house in 5 years' time and save for retirement after that. They are completely closed-minded to the idea that you can learn how to buy real estate and create income in other ways besides working at whatever job seems to offer the highest pay and most rewards at the time.

Personal debt levels are at record highs and savings rates at record lows. The way out of this mess is not to cut back spending and save more money. The answer is to learn how to earn more money and to re-ignite the entrepreneurial spirit in young people like it has been for people in overseas countries - namely China and India.

Yes, today's youth are facing an uncertain future, as the largest and most powerful generation in the world, the baby boomers, will be retiring. And yes, there are organizations that support and recognize the youth who will become our future leaders. There are also some amazing young people who get inspired by a cause and commit their time, and their piggy bank to do what many adults don't even think of doing. The question is, will enough of our youth be ready and prepared to take on the challenges their generation faces? Is there enough training and support to raise financially independent, hard-working, inspired, future leaders?

The young person in my story decided she wasn't getting the training she wanted despite being paid to review a very expensive CD program from one of the top professionals in her field. After less than 2 months, she decided she wanted more security and to be involved personally with the company's consultants. I'm not sure what she expected besides her regular paycheck but she certainly wasn't going to be the junior person in a start-up organization and have personal access to $1000-an-hour consultants. She decided to look for work while continuing to accept the payment for her training then gave 2 days' notice and expected to be paid the day she left - hmm.

I guess I should be so lucky; my brother owns a catering company and has shown up many times for work to find that the person who was supposed to start early on food preparation for that day just didn't show up because they were too tired from being out late the night before.

There are also the poor employers of young people who don't service the clients because a) it's their break time or b) the request by the customer is something they don't want to do or c) it was slightly outside the normal course of business.

The bottom line is the entitlement mentality is becoming an epidemic. And that's a problem because this Generation Y, as its known, expects to have all the benefits the current generation has worked hard for without the commitment to make it happen. There are too few young leaders who take up the challenges of our society. Those that do step up need support, and unfortunately this means they will have to work alongside the growing number of youth who jump from job to job and pay for things on credit they don't have money for, and then look to parents or the government to bail them out when they can't make things work for themselves.

One of my favorite success stories is a young woman who opted to work as consultant, rather than settling for an entry-level job right out of school. Her income jumped from $1500 per month to $7500 in 4 months because she followed her passion. Another young woman I know (still in high school) is very interested in fashion. Rather than take a retail job she found a way to open her own “shop” in the back of another store.

There are examples all around of young people who are making a difference - just a few more of them who aren't. It's time for business owners, teachers, parents, and other would-be “mentors” to stop bailing out our young people. “Generation Y” needs to take responsibility for their actions and to be committed to the decisions they make. We have to help more of them learn to earn a living for themselves so they understand the commitment and responsibility the people who employ them take on when they hire them. We have to help them understand that when they learn these skills they actually can have the securities and freedoms they want when they want them. We have to help them learn how to earn so they can be part of the change we so desperately need in North America to maintain our independence and financial freedoms.

Worldwide demand for fuel, metals and food staples are creating shortages, and prices on these items continue to increase. China’s recent economic expansion has had a huge impact on commodity supplies & prices. The same supply/demand fundamentals that have driven crude prices to new highs are now driving steel prices higher.

While demand for crude increases worldwide, US policy has been to conserve, rather than to increase supply. For years the strong dollar enabled the US to rely on the rest of the world to produce discounted resources that we would import to meet our nation’s growing demand. The resulting complacency resulted in a reliance on aging systems without any new additions to take their place. Over 30 years have passed since a major nuclear power plant, oil refinery or steel mill has been built in this country. The last ones we did build, which were state-of-the-art in their time, are becoming aged and antiquated and are no longer capable of producing enough to sustain current demands.

As the once mighty Yankee dollar loses its luster, our ability to import shortfalls cheaply is no longer the viable option it once was. To make matters worse, the worm has turned in the sense that the recent strength of the Euro and the dollar’s weakness are slowly turning the USA into an exporter where it once was the dominant importer. The result is an ever increasing demand on our already limited resources.

The shortages and resulting price increases we are seeing today are not an overnight occurrence. The US has more untapped natural resources than any country on the planet. As one of the largest consumers of the world’s resources, one would think we would be thinking of ways to use what we have. Yet, for the past 30 years, the US has adopted a policy of using the resources of others while preserving our own, treating them like holy relics that should not be touched. Instead of finding ways to tap known resources, the US for the past 30 years has relied on the rest of the world to do it for us.

Americans feel that their appetite for foreign resources should be met on command. The world should not only produce whatever we want, but do it at a low price. So, if we have a gas shortage, it’s the Middle-East’s fault. Drill more wells but do it on your land and off your shores; build more refineries but do it in your cities. We can’t do it in America because it’s dangerous, it’s bad for the environment, and it will pollute the oceans and destroy the planet, so you do it for us. Somehow, if another country does it, it’s different. If prices go up in the process, however, the rest of the world is being greedy. These countries need to find a way to keep up with our demand. They need to expand and build but do it on their own dime, quickly and efficiently and without raising their prices. Anything less and we’ll be outraged. How dare they? Unfortunately for the US, 30 years of neglect is not something that can be repaired anytime soon.

50 years ago, the USA was #1 in that we had the biggest and baddest of everything. We were building nuclear plants and had the world’s largest coal mines, the biggest oil companies and the best refineries. The iron range was cooking with activity and the country was producing steel in the biggest, most efficient steel plants in the world. Pittsburg, Pennsylvania was the steel capital of the world, and the USA was the industrial engine of the planet that everyone else looked to as the model for building their own economies.

The 1970’s was a time before computers, the internet and e-mail. Cell phones were the size of suit cases and a new technological age was in its infancy. Nuclear energy had its growing pains. The drilling and transportation of oil were still being done old school. We were adept at creating new technologies, but not at safeguarding them. Mistakes were made. While the rest of the world has adapted, refined and made full use of the new technologies, the US has not. More than 30 years have passed while the US continues to sit on the largest oil reserves in the world. We have not built a refinery, a steel mill or nuclear plant while the rest of the world has - and good ones at that. Yes we have the resources, but they not do us any good unless we utilize them.

While America sits idly by, the rest of the world has left us in the dust. The US has dropped from #1 to the 3rd largest producer of steel while Japan, a country with limited resources of its own, is now #2. We’ve regressed from being one of the largest producers to becoming the largest importer of crude in the world. The oil we drill we ship to the mid-east or to countries like Japan to refine, only to ship it back to the USA because we don’t have the capacity or the refining capability in the refineries we do have to refine the types of oil we do pump.

We have the brightest minds in the world, and were responsible for bringing nuclear energy to the world. Unfortunately, France now holds the title of world leader in this technology. They are energy independent, building for themselves and the rest of the world modern nuclear plants that generate energy without incident or accident. The USA, once known as the nuclear knowledge center, no longer has people with the knowledge to build a plant even it we wanted to. Most of these people are too old or have moved on to the countries that will utilize their knowledge and know how.

Environmental activists must acknowledge that what happened in the past is past. It’s 2008 and the technologies of today dwarf those that built the systems that caused concerns in the past. Look at other countries that didn’t go into a cocoon, countries that have taken the technologies of today and adapted them to improve the processes and safeguards of the 1970’s.

If France can produce safe and issue-free nuclear plants I think we can do the same here in the USA. If other countries can drill oil and ship and refine it without causing catastrophic effects, then I think we can too.

To continue to focus on the problems of 30 years ago and say that the same issues still exist is religion, not realism. In the end, we are responsible for the situation we find ourselves in today because of our own selfishness and greed. We must stop expecting others to do for us what we refuse to do for ourselves. In addition, we must stop criticizing them if they can’t do it quickly or cheaply enough. And then we wonder why the rest of the world thinks Americans are a bunch of pompous, self-centered morons

We need to get with the program and show the world we are not self centered-morons. We are a nation rich in resources, but we misuse and abuse them. With all our knowledge, all our resources and all our abilities, we proudly pat ourselves on the back for building ethanol plants that burn the food we grow to make energy that we already have in the ground but refuse to drill for. There is currently a shortage of rice and other foods in many parts of the world. We may think we’re cool and trendy and GREEN building ethanol plants to burn food to power our vehicles, but the rest of the world thinks we’re fools.

In the end, it’s a question of supply and demand. As world demand increases for the resources our planet has to offer, the supply needs to keep pace or some will have to use less. The best way to allocate limited supply is to eliminate some of the demand. This is done through prices. As prices rise, demand slows. Some will pay the new price and some won’t. Prices rise until the supply and the demand meet equilibrium, where what is demanded meets what is available.

Today, prices continue to rise because demand is still greater than the supply. Other countries claim that the US needs to start contributing to world supply and not depend on everyone else to make up the shortfalls. The US continues to refuse to do so. Building wind mills, solar panels and BURNING OUR CORN AND BEETS IS NOT THE ANSWER.

There is hope, however. As prices rise more and more, Americans are changing their attitudes. Many now agree that we need to start implementing real programs for utilizing our available resources IN A SENSIBLE MANNER. We need to once again take the lead. We need to drill new wells, build new refineries and harness the new, safer nuclear energy. We need to update our old mines and mills, and catch up to the rest of the world.

Unfortunately, 30 years of ignoring the problem cannot be undone overnight. Eliminating the red tape and writing rules and regulations that will safeguard our systems without making them too expensive to build will take time. Building these systems and getting them manned and producing will not happen overnight. While we can fix the problem that took 30 years to create, we will have to live through a few more years until we turn things around. For now, supplies will continue to fall short in a world where demand continues to rise. Where it will all end is impossible to predict, but one thing is certain. Prices are high and heading higher, with nobody knowing where they will end for now.

Oil Due for A Correction

Oil keeps hitting record highs, but whenever we see this type of hype, we can expect to see a much needed correction. When we see items become front page news, it is time to look for a serious correction. For example, nobody in the general investment market had a clue that wheat and grains were making dramatic gains. But as we started seeing reports in the last month on how expensive wheat was becoming, we saw a major turn in the price of wheat – it fell 45%.

The same story goes for rice. It started to rise dramatically, made it to the front page news, and then dropped almost 20%.

For oil we are in what is typically called the “shoulder season” and even though we typically see the high for oil in March, it is not unusual to see the price of oil peak in May. As with rice and wheat, the price of oil has risen too far, too fast – it is time for a correction.

Gold has been in a correction mode since mid March. But now we are seeing gold start to make a move, partially being driven by the spike in the price of oil. We are now looking for gold to make a move here, but be aware that should oil correct as we expect it will soon, then gold and silver will also likely retract with the price of oil, for a short period.

We like to look at the chart of the gold/oil ratio. This ratio has declined dramatically recently, and today an ounce of gold only buys just over 7 barrels of oil. On the chart, this ratio looks to be turning, meaning that it would make sense to lighten exposure to the oil sector and increase exposure to the gold and precious metals sector.

We cannot tell you that this ratio is going to turn tomorrow or the next week, but our analysis shows that we should see a rise in precious metals and a decline in oil stocks. This means that oil could continue to rise in the near term and gold could drop in the near term, but for our money we are accumulating more gold and silver stocks at this point in time. We are seeing some gold and silver stocks starting to rise, and this may be an indicator that the gold shares are looking to lead the way up.

With the stock markets, we have been looking for that point where the damage from the sub prime and credit crunch has been fully discounted. We have been hearing for over six months now that the worst is over and the market has fully discounted the worst from the sub prime and credit problems. Recently we have been reporting that the main issue today is the lending freeze that has been in effect. At this point we would be willing to suggest that the Fed has been reasonably successful in averting a credit freeze in the lending markets. But what we are still very uncomfortable with is that credit is still being extended by banks in the real estate market.

So while we see credit expanding in the real estate sector, it is how this is coming about that worries us. The banks are selling securities, mostly selling bonds to the Fed, which is creating much of the new liquidity. But what is troubling here is that we see a decline in deposits being held by US commercial banks, which is counter to the basics of banking 101. Typically you would see a rise in deposits, increasing the bank’s money supply – not so in this situation.

But what is even more troubling from our point of view is that these US banks are increasing their liquidity by borrowing from foreign banks. So here we have US banks selling securities, not based on deposit growth and they are borrowing from foreign institutions to expand this credit.

The next problem that we see is that this credit is being offered is being offered at a much higher price. So while the credit freeze seems to have been averted, at least temporarily, the price is much higher. So while we seem to have made our way past the Bear Stearns scenario, it looks like there is another shoe still to drop.

Today, we seem to be in a respite period where the markets have moved up and the commodities have pulled back some. We have been closely watching the dollar, anticipating a fairly strong rise soon. But as we can see on the following chart, the dollar rally that we have anticipated appears to have stalled – at least at this point.

At this point, we are seeing that investors are more interested in buying up the dipping gold price than they are at scooping of the cheap US dollar. We think that the reason is that the market does not like the way that the credit freeze has bee averted – it is not fundamentally sound. Stay tuned!

What remains after this exercise is a guide to the amount of money left to repay your bank, credit card and other 'non priority' credit debts. The court will make a repayment order based on the figure but also take account of monies owed on other credit agreements. In addition, the court will freeze the interest charges so that the debt no longer increases.

The negotiation of reduced debt payments simulates the approach taken by the court. It involves producing a detailed income/expenditure schedule, showing how much 'spare' money is available after priority payments have been made and proposing a fair distribution of this money. Arranging a debt management plan is something that you can do reasonably easily yourself, particularly if you use the self-help booklets available from National Debtline or your local Citizens Advice Bureau. Fee charging debt advice agenciesDebt advice agencies offer a similar debt advice service to the Citizens Advice Bureau but will also administer your reduced payments negotiated under a debt management plan. Your local CAB will often arrange for you to make reduced payments, but you will be responsible for making these payments.

The fee charging companies will also arrange that you pay your money over to them and they will pass it on. However, this additional facility comes at a price - the fee charging companies typically keep up to 15% of your regular payment as their fee and the whole of your first month's payment may also be swallowed up in administration costs.

Of course, paying somebody else to administer your payments means it takes longer to repay your debts. There is therefore little point in paying for a debt management company unless you think their service is worth it.

Disadvantages of debt management plans

Your credit reference file will show details of the Debt Management Plan. This will affect your ability to get credit in the future.

You must make sure that this is a suitable option for you and that the company operating the IVA fully understand and represent your financial situation.

A specialist insolvency adviser, called an Insolvency Practitioner, draws up a proposal for you to repay a specified amount in full repayment of your debt. The payment can be made in a lump sum or over a period of time - often up to five years. The companies owed money agree to write off any debt still outstanding once you have made the agreed payment. The amount paid under the IVA is normally calculated with reference to the amount that would be collected if you were to be made bankrupt.

A recent change in the law means that those experiencing bankruptcy for the first time can normally expect to be discharged after a maximum period of one year. You are then released from your debts (although you may be required to make regular payments for up to three years). You are expected to learn from your experience. People who go bankrupt again get a much tougher time.

You are subject to the control of the court;

Gas, electricity, and telephone contracts will need to be put in to the name of another adult who lives with you. If there is no other adult, you will have to change to a prepayment system or lose the service;

You cannot hold certain public offices while you have not been discharged from bankruptcy, nor can you continue as a director of a limited company;

Your access to credit will be severely restricted until you are discharged; thereafter you will pay higher rates of interest until you have re-established your credit rating;

Some debts will not be included within the bankruptcy. These include mortgage and other secured debts, magistrate court fines, debts payable after personal injury claims, and debts to the student loans company;

Any determination by the court that you have acted dishonestly or recklessly can lead to restrictions on your discharge from bankruptcy;

You will normally lose the use of your bank account and will be forced to open a 'basic' account with no overdraft and limited other facilities;

You should assume that your employer, friends, and neighbors will find out about your bankruptcy. Your bankruptcy will be publicized in the local Press and is available to anyone who wants to request information about you;

You will have to pay £475 to petition for bankruptcy.

State exemptions are promulgated by the constitution and statutes of each state to allow each resident citizen of that state to keep certain assets for themselves, notwithstanding that citizen may have a money judgment against him or her. Each state has its own set of exemptions. Some states are much more generous than others. It is important to note that exemptions do not apply to businesses; they only are available to human beings.

Texas has probably the best state exemptions over any other state. Some say Florida and Nevada have the best. It all depends on what kind of assets you own and whether Texas, Florida, Nevada or your state of residence exempts them and how much in value can be exempted. State exemptions are only applicable to you for the state in which you maintain your principal residence or legally have your domicile.

Texas exempts two types of real property: (a) one or more cemetery plots: and (b) a homestead. Either families or single adults may claim homesteads. The homestead may be either rural or urban. An urban homestead may be used as a home and business. The size of an urban homestead is the same for families or single adults: it may consist of up to ten acres on one or more contiguous lots, including any and all improvements on the land. A rural homestead for a family is limited to 200 acres and includes any improvements on the land. A rural homestead for a single person is limited to 100 acres and any improvements on the land. So, you can build the Taj Mahal on your urban homestead of 10 acres or less and feel secure in living out your days in peace, so long as you pay your mortgage, taxes (income and property) and those you hire to improve or add on to your property. The same goes for a rural homestead. If you sell your homestead, the proceeds are exempt for six months. In other words, if you do have a creditor with a judgment against you, you have six months to reinvest in another homestead or other exempt property or spend it, or any combination thereof.

Now, lets discuss personal property exemptions in Texas. We have two different types of exemptions for personal property: (1) an "aggregate" exemption for certain kinds of personal property, limited by the combined value of the property; and (2) unlimited exemptions for other kinds of personal property. Families and single adults may exempt certain kinds of personal property from the claims of creditors as long as the combined fair market value of the property does not exceed: (1) $60,000 for a family; or (2) $30,000 for a single adult. The kinds of personal property that may be included in the aggregate exemption are: (a) home furnishings and family heirlooms; (b) food and staples; (c) farming or ranching vehicles and implements; (d) tools, equipment, books and apparatus, including boats and motor vehicles, used in a trade or profession; (e) clothes; (f) jewelry, as long as it does not exceed 25% of the value of the aggregate $60,000 or $30,000 exemption; (g) two firearms; (h) athletic and sporting equipment, including bicycles; (i) a motor vehicle for each member of a family or single adult who holds a driver’s license or does not hold a drivers license but relies on another person to operate the vehicle for the unlicensed person; (j) the following animals, including food on hand for their consumption: (A) two horses, mules, or donkeys, including a saddle , blanket and bridle for each one; (B) 12 head of cattle; (C) 60 head of other types of livestock; and (D) 120 fowl; and last, but not least, (k) household pets. There is one more addition to this list and it is unpaid commissions for personal services as long as the amount does not exceed 25% of the $30,000 or $60,000 aggregate.

In addition to the kinds of personal property that may be exempted under the aggregate exemption just described, a debtor may also exempt, without regard to value, the following kind of property: (a) current wages for personal services; (b) professionally prescribed health aids of the debtor or a dependent of the debtor; and (c) alimony, support, or separate maintenance received or to be received by the debtor for the debtor’s support or a dependent of the debtor. "Current wages" are wages owed to an employee. Once the wages have been paid to the employee, they are not "current wages" for and they are no longer exempt. This means that if you are an employee, your employer cannot be required to hand over your paycheck to your creditor, but if you deposit it in an account or cash it in, it is no longer exempt. If you know your payday after taking the loan then you can arrange a direct debit to be applied on that date, and the payment will be made before you can access your account. That way there will be no temptation to spend the money before you pay it back.

If payday is a Saturday or Sunday, then you will be paid on the Friday, so arrange the direct debit for the Friday. If you have taken the loan out close to payday, you might have made an arrangement to pay next payday: in that case the same arrangements will apply.

If you ever make an arrangement to make repayments over a number of months, then it will be difficult to arrange a single direct debit date, and that kind of payment is not variable: it is made on the same date each month. Many people I know come to an arrangement with their bank in such situations.

You can open another account with your bank after discussing your problem with them, and arrange the bank to transfer your payment to that account on payday, and then have the direct debit remove that for your payday loan repayment on the 1st of each month. I know this all sounds a bit complicated, but it works for many people, and helps them to keep clear of rollovers that can end up with them owing more than they borrowed.

However, payday loans have many benefits if you are able to make the payment at the right time. It will give you emergency cash when needed, such as an emergency car repair or medical bill, and allow you to pay it back next payday. How often have thought ‘I could pay that in a couple days – I wish it were payday today’? Well, payday can be ‘today’ with a payday loan, arranged the same day, or at least within 24 hours.

So payday loans do have benefits to those that need them, and if you need one then think carefully before taking it, and make sure you get the best deal. The take it and use it well.

During the subprime crisis we saw the advent of numerous bizarre loan products. In general the new loan products were designed to get people into houses they could not normally afford. As people started to default on their mortgages banks realized many of these loan products were not a good idea. During the subprime crisis we saw most of these new loan programs fall to the wayside. I think in most cases this is a good thing. Many of these new loan products reduced the chances that individuals could gain equity in their homes by paying off principle. When difficult times arose for people they were in a difficult position because although they had made years of payments their loan balance had not changed. The worst of the new loan products had "teaser rates" so that individuals made low payments for a few years until the rate and their mortgage shot up. Its a wonder why banks are surprised by the number of foreclosures.

The one product that has seemed to survive the subprime meltdown is the 40 year loan. I am not a fan of the 40 year loan. Mostly because the savings are minimal. Lets look at the current mortgage interest rates from Wells Fargo for a 40 year, 30 year and 15 year loan.

40 Year Loan = 6.375

30 Year Loan = 5.75

15 Year Loan = 5.125

Now using a mortgage calculator lets look at the mortgage payments on a 200k house.

40 Year Loan = 1153.14

30 Year Loan = 1167.14

15 Year Loan = 1594.64

While the difference between a 30 year loan and a 15 year is substantial, $441.50, the difference between a 40 year loan and a 15 year loan is only $14 per month. A little savings but is it really worth adding a whole extra 10 years to your mortgage. So over 30 years $14 dollars a month amounts to $5040. On the other hand an extra 10 years of mortgage payments comes out to $138,377. To run the numbers a different way by putting down a mere $2400 on your 30 year loan you would get the same mortgage payment as you would on a 40 year loan.

Obviously everyone's situation is different and in a small number of cases a 40 year loan might be warranted. But in general the 40 year loan adds extra years to a person's loan for a minimal benefit.
